Gladstone Solicitors' Particulars of Claim Struck Out in Multiple Cases

In recent cases at the County Court in St Helens, Mr Jackson Yamba of Lawrence & Associates Solicitors successfully applied to have the Particulars of Claim struck out in multiple cases brought by Gladstone Solicitors against their clients.

Gladstone Solicitors had been representing several parking companies in pursuing alleged debt claims. However, Mr Yamba argued that the Particulars of Claim filed by Gladstone failed to properly set out the key details in each case, including the specific contractual terms relied upon, details of the alleged breaches, and quantification of the claimed losses - in breach of Civil Procedure Rules 16.4, 16PD3 and 16PD7.

The judge agreed, finding the rules require clear and unambiguous particulars to be provided from the outset. All too often, legal representatives such as Gladstone fail to comply with mandatory procedural requirements, making it difficult for defendants to understand the substantive case against them.

This victory sends a clear message that substandard pleading will not be tolerated. As a result of Mr Yamba's applications, costs orders totalling over £3,000 were made against Gladstone Solicitors.
