ANOTHER BLOW TO BRITANNIA PARKING REPRESENTED BY BW LEGAL SERVICE

After lamentably failed to prove their case against Mr Jackson Yamba and Contestor Legal Services before the County Court at Bournemouth, Britannia Parking Group Limited, represented by BW Legal  has been ordered at this time to pay costs of £1,420.00 before the County Court at Uxbridge to our client

In a nutshell, our client  was parked at Pinner, the Ascott, HA5 1RJ(“Car Park”) her vehicle was captured by the ANPR camera between 13:00PM  and 16:25PM.  On the date of the alleged contravention, the Car Park was very busy due to some building work taking place next door to the pub. At least 1/3 of the spaces were occupied by contractor’s vehicles, lorries and scaffolding restricting the available number of spaces.

Our client waited for a free parking space to become available at the entrance of the Car Park for around 13 minutes. After a parking space became available, our client parked, read the terms and conditions and decided to accept them by making payment to the cash machine.

Unfortunately, the cash machine did not accept all the coins and our client  directed herself to the pub to get her note changed to coins. After queuing for a few minutes, our client obtained the coins and finally made payment and obtained a parking ticket.

Our client was issued with parking charge for failing to make a valid payment despite the fact that  she purchased a valid ticket on the date of the alleged.  She appealed against the charges which was rejected.  BW Legal were then instructed about the claim by Britannia Parking to issue proceedings.

Before proceedings were issued, we responded to the letter before claim and made it clear that our client was not liable and the charges should be rescinded.  Despite our warning and kind advise,  Britannia Parking persisted with the claim by issuing proceedings against our client.  We drafted a robust defence and advised our client to instruct a solicitor and make an application to strike out under Part 3.4 and summary judgment under Part 24.

At the hearing, BW Legal persisted as usually with their baseless, unfounded and even malicious attack against Mr Jackson Yamba who was instructed by Lawrence and Associates Solicitors as Solicitor Agent.

 After hearing both side of the arguments, the Court was convinced by the argument put forward by Mr Jackson Yamba on behalf of our client and strike out of the claim under CPR 3.4 and ordered Britannia to pay costs of £1,420.00.

The decision is a clear message sent to parking company who are  badly advised by their legal representative. We are proud of our records and we have assisted many people in providing them with the appropriate legal assistance at low costs or no win no fee.
